These Terms of Service (these "Terms") are a binding agreement between Ron Hot LLC, a Texas limited liability company ("Company," "we," "us," or "our"), and each person or entity that accesses or uses https://www.ronhot.com and any related sites, apps, products, content, or services we control (collectively, the "Services").

By accessing or using the Services, you ("you" or "User") agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your state, you may use the Services only with the consent of a parent or legal guardian who agrees to these Terms. You must be at least 18 to make purchases.

4. Purchases and Billing (Digital Downloads Only)

Pricing and Taxes. Prices are shown before taxes unless stated otherwise. You are responsible for any applicable taxes and fees.

Payment. By providing a payment method, you represent that you are authorized to use it and authorize us (and our payment processors) to charge all amounts due for your order.

License to Digital Downloads. Upon purchase, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the purchased digital content for your own personal, non-commercial use. You may not copy, redistribute, resell, sublicense, publicly display, or share the files (including posting them online or sharing with others). We may use watermarks and/or reasonable technical measures (e.g., download limits) to protect our content.

Delivery. Digital items are typically delivered immediately via download link and/or made available in your account after successful payment. Access windows or download counts may be limited.

All Sales Final (No Refunds). Because our products are digital, all sales are final and non-refundable except where required by law. If you experience a technical issue (e.g., corrupted file or incorrect download), contact us via our Contact form at https://www.ronhot.com/contact within 7 days of purchase and we will re-deliver or replace the affected file.

Promotions & Errors. Promotional prices may be time-limited. We may cancel an order and refund you if a product was listed with a material error.

5. User Content; Feedback

User Content. The Services may allow you to post, upload, submit, store, or transmit content ("User Content"). You retain your rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works, publicly perform, publicly display, and distribute your User Content solely for operating, improving, and promoting the Services.

Representations. You represent and warrant that: (a) you own or have the necessary rights to your User Content; and (b) your User Content and use of the Services will not infringe, misappropriate, or violate any rights of any third party or any law.

Feedback. If you send us ideas or suggestions ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback without restriction or compensation.

6. Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, fraudulent, infringing, or harassing purposes;

• Interfere with, disrupt, or degrade the operation or security of the Services;

• Attempt to circumvent access or usage limits or probe, scan, or test the vulnerability of systems without authorization;

• Use scraping, robots, or similar data-gathering tools without our express written consent;

• Post or transmit malware, spam, or content that is defamatory, obscene, hateful, or otherwise objectionable;

• Impersonate any person or misrepresent your affiliation.

We may remove or disable access to any content (including User Content) at our sole discretion.

7. Intellectual Property

The Services (including all content, text, images, graphics, logos, designs, audio, video, code, and software) are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Services, nor reverse engineer or attempt to extract the source code, unless laws prohibit those restrictions or you have our written permission.

Trademarks. Our names, logos, product/service names, designs, and slogans are trademarks of Ron Hot LLC or our licensors. You must not use such marks without prior written permission.

8. No Professional Advice; Food Safety & Allergen Notice

No Professional Advice. Content on the Services is for informational purposes only and does not constitute legal, financial, medical, or other professional advice. You are responsible for your own decisions.

Food Safety & Allergens. Recipes and food-related content are provided for general informational and educational purposes. Hot peppers and spices can cause adverse reactions. Use proper food-handling, preparation, and storage practices. Check for allergens and consult a qualified professional if you have dietary restrictions, medical conditions, or concerns. Use at your own risk.

9. Third-Party Content and Services

The Services may link to or integrate third-party websites, apps, products, or services. We do not control or endorse third-party services and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and may be subject to their terms.

10. Communications; Marketing; SMS

By providing contact information, you agree that we may send you service notices and administrative messages. If you opt in to marketing emails or SMS, you consent to receive promotional messages. You can opt out using the provided mechanisms. Message and data rates may apply for SMS.

11. Export and Sanctions Compliance

Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, limitation of liability, dispute resolution).

13. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICES THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations; if those laws apply, the above limitations will apply to the fullest extent permitted.

15. Indemnification

You agree to defend, indemnify, and hold harmless Company and our affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your User Content, your use of the Services, or your violation of these Terms or applicable law.

16. Dispute Resolution; Arbitration; Class-Action Waiver

Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by submitting via our Contact form at https://www.ronhot.com/contact with "Dispute" in the subject line and a brief description. If we cannot resolve it within 30 days, either party may bring a formal proceeding.

Binding Arbitration. Except for small-claims cases and claims seeking injunctive relief, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration under the Federal Arbitration Act (FAA) and administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Section. Arbitration will be conducted in Dallas County, Texas, or by telephone/virtual appearance at the arbitrator's discretion. The arbitrator's decision will be final and binding, with limited court review.

Class-Action/Jury Waiver. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU ALSO WAIVE ANY RIGHT TO A JURY TRIAL.

Opt-Out. You may opt out of arbitration and the class-action waiver by sending written notice to the mailing address below or via the Contact form within 30 days after you first accept these Terms. Your opt-out will not affect other Terms.

Governing Law and Venue. These Terms and any non-arbitrable disputes are governed by the laws of the State of Texas, without regard to its conflicts of laws principles, and the exclusive jurisdiction and venue for such disputes will be the state and federal courts located in Dallas County, Texas. You consent to personal jurisdiction there.

17. Copyright Complaints (DMCA)

We primarily offer our own digital content and do not ordinarily host user uploads. If you believe that content on the Services infringes your copyright, please see our DMCA page at https://www.ronhot.com/dmca for our Designated Agent's current contact information and instructions. We may remove or disable access to allegedly infringing material and may terminate repeat infringers.

18. Privacy

19. International Users

We are based in the United States. We do not represent that the Services are appropriate or available for use outside the U.S. Accessing the Services from territories where the content is illegal is prohibited. You are responsible for compliance with local laws.

20. Miscellaneous

Entire Agreement. These Terms are the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements on that subject.

Severability. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will remain in full force.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.

Headings. Headings are for convenience only and do not affect interpretation.
